5 The Legal Process
For the sale of your property to proceed, you will need to appoint a solicitor to administer the legal work involved in the property selling process.
  • The vendor's solicitor obtains property title deeds and other relevant documentation including, if necessary a HIP, prepares draft contract of sale and passes all papers to the buyer's solicitor.


  • The buyer's solicitor will then examine all property documentation, carry out a Land Registry search and Local Authority search (unless provided by the HIP) and raise any enquiries or resulting issues with the vendor.


  • When the buyer's solicitor has satisfied all enquiries regarding the property, received an acceptable local search, a mortgage offer (subject to satisfactory survey) and a signed contract and deposit from you, the buyer, the exchange of contracts can go ahead and the sale will then be legally binding.
